missing patient at san francisco general hospital later found dead in a stairwell. an attorney for the sheriff deputies dispute reports of this being a witness. a man told a hospital supervisor someone was lying in the stairwell four days before lynn spalding's body was found by a being engineer october 8. the man is believed a hospital employee disappeared before being questioned. an attorney says the story does not add up and says no one has found the purported witness and he don't think he gives. >> hatching -- happening a now a missing cupertino man is considered at risk. dennis brakes is -- brooks is suffering from dementia. he disappeared yesterday afternoon.

expressway we have another report of an accident and that is causing the backup as you head into downtown san jose and the traffic advisory is in effect because of 1,000 spilled used syringe needles and is closed at apian way. >> we have develop news from new jersey, an all-night search for a gunman who opened fire in a crowded shopping mall and was found dead this morning. we are learning new details about the shooter. our reporter is monitoring the latest developments from the newsroom. >> police found the body in a back area of the mall under construction more than six hours after he entered the plaza mall. police have identified the shooter and this is his picture, 20 years old. the picture was taken from a modeling website. shoop lived with his parents in new jersey. authorities found a note at his home.

in the note shoop expressed the end was coming but it is not clear if he feared being arrested or wanted to die. he is a known drug user and dealer. he did not write the note just before entering the mall. he entered the mall at closing time with all black and started shooting. thousands of people were able to get out before police locked down the mall but 400 shoppers were trapped while officers searched for the gunman. >> guy is grabbing the customers, there is a shooter, a shooter. they locked the door and closed the gate and everyone was dropping stuff and run for their lives, literally. >> no one was hurt. authorities do not think shoop ever intended to shoot anyone he shot at the ceiling and an elevator. authorities say the gun he used was stolen from his brother, a legal .22 caliber rifle changed

dealers have to keep all records of sales and owning magazines with more than ten rounds is illegal. the mayor says he was inspired to put forward the ballot measure by mayors against illegal guns because nothing was being done in congress or at the state level. the group founded by new york mayor bloomberg contributed $3,000 to the measure. opponents including the owner of a firearms company says it is a poorly drafted measure and will drive businesses to surrounding cities. if the measure passes, the national rifle association says they will sue to stop it from being implemented. the polls will stay open from 7:00 this morning until 8:00 this evening. >> the pleasant hill city council approved a proposal to regulate future gun shops in the city which forces the owners and

it is the largest casino in california that can handle thousands. the casino is located west of highway 101. the c.h.p. has heard some say it could bring in 10,000 extra cars a day. others predicted up to 40,000 extra cars a day. here is how c.h.p. says it will adapt. >> we have 15 extra c.h.p. officers in this area to help out rohnert park police which are out in extra numbers with a joint command center by the police department with the row -- rohnert park police and fire getting word from the field on what conditions are like so we can respond accordingly. >> they will leave the command post in place through the weekend and adapt. to traffic is not an issue, they will shut down. they will monitor the situation for the next few days to see
